The retired oil executive, 61 says he had promised not to oppose Batali’s application for a variance if the chef agreed to terms including soundproofing the restaurant.

The lawsuit says Batali hasn’t upheld his end of the agreement.

“Once Batali got his variance, he just turned his back on my client,” Akgul’s lawyer, Jack Lester, said.

The suit says that Akgul’s town house at 108 Waverly Place now stinks of food grease and that he can’t sleep at night because the eatery’s air conditioners cause “unrelenting vibrations and a chronic hum.”

“The humming is so intense, I cannot even open my window in the back,” Akgul said.

“I can smell everything they cook, the garlic, and when they use chemicals to clean the exhaust dust we get the stuff in our windows. It’s really a nuisance.” NY POST
